解除雇佣关系的形式之一:Dismissal 解雇
三种解雇的类型:
Actual dismissa l实际解雇 The termination of an employees’ contract by the employer
Deemed dismissal 推断解雇:劳动合同到期后,没有续期
The ending of a fixed-term contract without renewal on the same terms.
Constructive dismissal 建设性解雇:是员工自己辞职由于雇主的违背合同(加班不提供三倍工资)
Resignation by employee where the employer’s conduct breaches the contract of employment
两种违法的解雇方式:
Wrongful dismissal 非法解雇/错误解雇:违背劳动合同,即没有period of notice, 企业没有按合同提前一个月通知员工被解雇
A claim for wrongful dismissal is a common law action for breach of contract
Unfair dismissal 不公平解雇:解雇理由明显不合理,比如因员工的性别、年龄、是否怀孕、婚姻状况而解雇 A dismissal without good reason.
